Terms and conditions

This is a translation. The German version (AGB) is legally binding.

1. Scope and provider

These terms apply to the use of StintOS: the Windows program, the StintOS account, the app and the services on our servers (team, leaderboard, analysis, updates). The provider is Kevin Welsch, [Street and number], [Postcode, city], Germany, email info@stintos.com (“we”). Users' own terms do not apply.

2. Services

During an iRacing session StintOS reads the telemetry and shows it in overlays, on dashboards and in the app, calculates strategies, speaks calls and stores laps for the leaderboard and analysis. The scope of each plan is described on the pricing page at the time you sign up. You need your own valid iRacing subscription; StintOS is an independent program and is not affiliated with iRacing.com Motorsport Simulations, LLC.

StintOS is continuously developed. We may change, extend or replace features as long as the agreed core of the subscription remains and the change is reasonable for you. We inform you by email before significant changes to the subscription.

3. Account

You need an account to use StintOS. Your details must be correct and you keep your password secret. An account is personal and may not be passed on. Minors need the consent of their parents or guardians. A contract for the free plan is concluded when you complete sign-up.

4. Free plan and subscription

The free plan costs nothing. The subscription is paid; the price shown before you conclude it applies, including statutory VAT. The subscription contract is concluded when you click the button for the paid order on the payment page. Payment is made in advance for the chosen term via [Payment provider].

The subscription runs for one month or one year, as you choose, and then renews for an indefinite period. You can cancel at any time to the end of the current term, and after a renewal at any time with one month's notice. You can cancel under “My account” with the “Cancel subscription” button [Cancellation button (§ 312k BGB) before the subscription launches] or by email. We may cancel with one month's notice to the end of a term. The right to terminate for good cause remains.

We announce price changes for running subscriptions at least six weeks in advance; you may then cancel with effect from the change.

The subscription is valid while you are logged in to StintOS. When it ends, your account continues on the free plan.

5. Rules of use

You may not

• falsify lap times or recordings or submit them bypassing the leaderboard,
• burden our servers with automated mass requests or circumvent protective measures,
• modify, reverse engineer or resell StintOS unless the law expressly permits it,
• infringe others' rights or spread offensive content through names, team names or messages.

In case of a violation we may remove affected laps from the leaderboard and, after a warning, suspend the account; for serious violations also without warning.

6. Leaderboard and content

By uploading a lap you allow us to show your name, time, sectors and conditions in the leaderboard and to make the lap available to others as a ghost or for comparison. We do not show your customer ID, iRating, licence or setup. This permission ends when you delete your account.

7. Availability

The program keeps running on your PC without our servers, the subscription also for a few days without a connection. We aim to provide the services on our servers continuously; maintenance and faults can cause interruptions. The availability of iRacing is not in our hands.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee. For slight negligence we are only liable for breach of an essential contractual obligation whose fulfilment makes the contract possible and on which you may rely, and then limited to the typical, foreseeable damage. Otherwise liability is excluded. Calls and strategies from StintOS are recommendations; you make the decisions in the race.

For the free plan we are liable, except for intent, gross negligence and injury to life, body or health, only as a donor (§ 521 BGB).

9. Data

How we process your data is described in the privacy policy. You can delete your account at any time under “My account”.

10. Changes to these terms

If we change these terms we notify you by email at least six weeks in advance. If you do not object before they take effect, the new terms apply; we point this out in the notice. If you object, either side may terminate the contract with effect from the change. Prices and the core of the service are not changed this way.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, the mandatory consumer protection rules of that country remain unaffected. If individual provisions are invalid, the rest remains valid.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise the right of withdrawal, you must inform us (Kevin Welsch, [Street and number], [Postcode, city], email info@stintos.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your notice before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed of your withdrawal. We will use the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the service begin during the withdrawal period, you shall pay us an amount proportionate to what has been provided until you informed us of your withdrawal, in comparison with the full coverage of the contract.
